Candidates must file a certain number of petition signatures from eligible voters to be on the ballot.

In this case, the number was 500.

Evans submitted more than that, but the board invalidated a number of those signatures for various reasons, leaving him 11 short.

Evans filed his lawsuit on Wednesday, which was the deadline to challenge the board's findings in court, according to his attorney.

He is requesting expedited consideration.

If he gets on the Democratic line, he would force a June primary against John Perticone, who currently sits on the Town Board.

Perticone and other board members, meanwhile, have been pushing Evans to resign over allegations that he sexually harassed and retaliated against a female staffer.

Monroe County District Attorney Sandra Doorley is seeking a court order to remove him from office.

Evans has apologized but maintained that he is being attacked for political purposes.
