The former Chief Operating Officer of Morgan Management, Scott Cresswell, has pleaded guilty to conspiracy to commit wire fraud.
That’s according to the U.S. Attorney’s Office, which says that between March 2017 and April 2018, Cresswell conspired with others, under the direction of real estate developer Robert Morgan and others, to fraudulently obtain insurance policy proceeds for repairs on properties managed by Morgan Management.
Robert Morgan has not been charged in this case.
Previously, 35-year-old Patrick Ogiony of Buffalo pleaded guilty to conspiracy to commit bank fraud. Federal authorities said that Ogiony conspired with his co-defendants to defraud financial institutions, by providing false information overstating the incomes of properties owned by Morgan Management or certain principals of Morgan Management.
Another defendant, Kevin Morgan, previously was convicted of conspiracy to commit bank fraud. Kevin Morgan is the nephew of developer Robert Morgan.
Charges remain pending against Frank Giacobbe and Todd Morgan. Todd Morgan is Robert Morgan’s son.
The U.S. Attorney for Western NY, James Kennedy, released a statement saying that with the plea by Cresswell on Monday, his office, along with the FBI and Federal Housing Authority, “have peeled back yet another layer in this extensive fraud scheme.”
