Monroe County Clerk Sues State DMV Over Spitzer License Plan

Rochester, NY – Monroe County Clerk Cheryl DiNolfo has filed suit against the New York State Department of Motor Vehicles. She's asking the State Supreme Court to block Governor Spitzer's plan that would allow illegal aliens to get a drivers' license.

DiNolfo is one of a number of Republican County Clerks who have refused to carry out the Democratic governor's plan. She says it violates state law, which requires a valid Social Security number in order to apply for a license. DiNolfo says the governor's plan would give illegal immigrants a license that looks like every other New Yorker's. She says that's a loophole that could be exploited by terrorists.

State Assembly Republicans filed suit against Governor Spitzer and the DMV earlier this week, also seeking to block the plan. DiNolfo says her suit is separate from theirs, and not on behalf of any other county clerks.

The drivers' license issue has worked its way into local political races in Rochester and Monroe County. Both DiNolfo and Republican Monroe County Sheriff Patrick O'Flynn have recorded automated phone messages which have been sent to local voters. They claim voting for Democrats "threatens our safety" and urge people to elect Republicans to the Monroe County Legislature.
