Lawsuit filed over Whole Foods plaza development proposal in Brighton

A neighborhood association has filed a lawsuit against the proposed Whole Foods Plaza in Brighton.

The Clover/Allen’s Creek Neighborhood Association filed a suit in State Supreme Court concerning the process involving the development proposed by The Daniele Family Companies on Monroe Ave. near Clover St.

The suit claims the developer has been allowed to take control of a public trail, a walking and biking path known as the Auburn Trail.

The homeowners group also has issues with how the public was notified about some meetings concerning the project where there was a chance to give input.

There is a public hearing to consider the incentive zoning application on the Whole Foods project, scheduled for February 28th at 7pm at the Council Rock Elementary School.
